1. Agreement to Terms

By accessing or using Swipi ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. The Service is operated by Swipi ("we", "us", or "our").

You must be at least 13 years of age to use this Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of Service

Swipi is an interactive content platform that allows users to create, play, remix, and share mini-apps and games. The Service includes AI-powered content creation tools, a social discovery feed, and a library of interactive H5 games and applications.

3. User Accounts

  • You may browse and play content without creating an account.
  • To create, publish, or interact with content (e.g., liking, commenting, bookmarking), you must create an account.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You agree to provide accurate and complete information when creating your account and to keep this information up to date.
  • We reserve the right to suspend or terminate accounts that violate these Terms or our Content Policy.

4. User Content

"User Content" means any games, apps, code, text, images, comments, or other materials you create, upload, or publish through the Service.

  • You retain ownership of the User Content you create. By publishing User Content on the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, display, distribute, and make your content available to other users through the Service.
  • You represent that you have the right to publish all User Content and that it does not infringe any third party's intellectual property or other rights.
  • All User Content must comply with our Content Policy.
  • We may remove or disable access to any User Content that violates these Terms or our Content Policy at our sole discretion.

5. AI-Generated Content

The Service provides AI-powered tools for generating interactive content. Content generated using our AI tools is subject to the following:

  • AI-generated content is subject to the same rules and guidelines as all other User Content.
  • You are responsible for reviewing AI-generated content before publishing it. You are the publisher and bear responsibility for any content you choose to publish.
  • We do not guarantee the accuracy, quality, or appropriateness of AI-generated outputs.
  • We reserve the right to use anonymized prompts and usage patterns to improve our AI services.

6. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service except as expressly permitted by these Terms.

7. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Upload or distribute malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to the Service, other user accounts, or our systems
  • Circumvent any security measures, content moderation, or access controls on the Service
  • Use automated tools (bots, scrapers) to access the Service without our permission
  • Harass, abuse, or threaten other users
  • Impersonate any person or entity
  • Use the Service to infringe any intellectual property rights

8. Game Content & Sandboxing

User-created games and interactive content run in sandboxed iframes with restricted permissions. We take reasonable measures to isolate game content from the main platform, but we do not guarantee that all user-created content is free from bugs, exploits, or unintended behavior.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless Swipi, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your use of the Service, your User Content, or your violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration.
